Queens Neighborhoods United (QNU) is set to rally against the construction of a Target store in Elmhurst. The rally will take place at Dunningham Triangle next to the construction site on Sunday, Jan 6. at 1 p.m. The group claims that the construction is illegal as it violates local zoning codes prohibiting big box department stores.

Following the rally, QNU will join New York State Senator Jessica Ramos and community members to challenge the construction to the New York Supreme Court in efforts to permanently stop the construction.

The anti-gentrification group has had several successes in the past in relation to stopping the construction of the department store. From forcing the developers, Sun Equity Partners and Heskel Group, to withdraw their rezoning application and settle with a smaller site to being granted a stop work order in August.

Despite this, the developers revised their plans in late September which proposed space for five separate stores. The Department of Buildings (DOB) granted the developers approval to build the Target at 40-31 82nd St.

QNU and its legal counsel, the Community Development Project, previously filed an appeal with the Board of Standards and Appeals (BSA) to challenge the Department of Buildings. However, the BSA is backlogged on appeals and cannot hear the case until March.

QNU and Senator Ramos will take their case to the New York Supreme Court on Thursday, Jan. 9 at 9:30 a.m.
